DC FEDERAL COURT RUBBERSTAMPS TSA GESTAPO

In an event that should not shock real Americans, the corrupt Federal Court in the D.C. Circuit ruled that the invasive scans of Americans traveling by air (and soon at the bus and train stations) are not a violation of the Fourth Amendment text below:

"The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."

Evidently, the "right of the people to be secure in their persons," was somehow missed by this kangaroo court. These scanners are no different than the TSA Gestapo having people disrobe and being subjected to a body search without a warrant merely because they wish to fly and the other choice is to undergo a same sex ball grab or boob grope, unless you're a toddler or an elderly person, and then it is a diaper inspection. What's next? Taking a turd out of a toddler's diaper and running it through a scanner to ensure there is no Semtex in it?

Judge Ginsburg wrote:

"On the other side of the balance, we must acknowledge the steps the TSA has already taken to protect passenger privacy, in particular distorting the image created using AIT and deleting it as soon as the passenger has been cleared. More telling, any passenger may opt-out of AIT screening in favor of a patdown, which allows him to decide which of the two options for detecting a concealed, nonmetallic weapon or explosive is least invasive."

So Americans have a choice between having a naked picture of themselves viewed by an anonymous TSA clown and hopefully deleted or opting for a ball grab, boob grab, diaper inspection, wheelchair rape job, etc., and the DC Federal Court is okay with this.

The last time the Gunny checked, the government cannot force the citizenry to make a Hobson’s choice between two unconstitutional options and if they decline, they suffer something like an arrest or a prohibition on flying on a ticket they have purchased. And for a court to look at the choices and say that they meet the requirements in the Fourth Amendment is almost a joke. Now the TSA goons are referring to a bullsh*t report from the DHS about surgically implanted bombs that could bring down an airliner, but unfortunately for us, those scanners made by a formerly Soros owned company cannot scan that deep so body cavity searches must be on the way. While that would excite the likes of Barney Frank, it is rather upsetting to the rest of America.

Interestingly enough, the courts have upheld the metal detector searches to prevent guns from being smuggled on board, as well as searches of carry-on bags and yet that did not prevent 9/11 from happening, just as the TSA has not prevented any acts of terrorism, i.e., the shoe bomber, the panty bomber. These scanners and the ball grabbing goes way beyond the pale and thus, violate the normal administrative searches understood to be safety checks or special checks and thus, not a violation of the 4th Amendment. The new screenings offer us a choice to be viewed in the nude or enjoy a nice genital massage and the DC Federal Court merely rubber-stamped this outrage by this regime using old decisions based on old searches. In other words, we’re getting screwed again especially when one considers the fact that there is no legal way that the government can force Americans to waive our Fourth Amendment right in order to fly to a destination on a ticket that we have purchased.

We have not consented to have our rights violated and forcing Americans to choose between one unconstitutional violation or another, merely to fly an airplane, or soon, to ride a bus or a train, is morally wrong, the Obama regime and Janet Incompetano do it anyway, and Congress could not give a damn. Oddly enough, our elected officials rarely fly commercial and when they do, they can bypass the security that we have to endure, just like they wrote themselves out of Social Security for decades and vote in laws that allow them to game the stock market.

In conclusion, the States need to ban together and boot the TSA out of their airports and use private security set up ala the Israeli model. If the tyrant wants to impose a "no-fly" zone across the US, like the pissant threatened to do to Texas, then let him. When the airlines lose billions and the union vermin start to complain and not be able to route their union dues into the Democrat coffers, the sh*t will change.

"But where says some is the King of America? I'll tell you Friend, he reigns above, and doth not make havoc of mankind like the Royal Brute of Britain…let it be brought forth placed on the divine law, the word of God; let a crown be placed thereon, by which the world may know, that so far as we approve of monarchy, that in America THE LAW IS KING."

  1. Face it, Gunnery Sgt.
The TSA is totally ineffective against any determined terrorist attempt. It is the teddy bear in the crib type security. It might give some idiots a feeling of safety but TSA does nothing but drain more money from our coffers for folks who do nothing but stand around fondling folks and feeling self important.

  2. I had to go pick my dad up at the airport a couple days ago. I haven't been in an airport since I came home from Gulf War I. The TSA guy was really helpful. He said sit over there and wait. Big help.

I guess this issue doesn't enrage me cause I don't fly. But everyone that does should just quit for a week. That would cost airlines enough money to get them involved.

  3. Gunny, the Dumbocraps could care less about anything but their own money and power. Anything (and I do mean anything) that increases their personal money and power is OK by them.

The only way we are going to be able to stop this BS is to get rid of every politician in DC and replace them with real men and women.

  4. Buck,

You are exactly right. As far as I am concerned, they are zero for whatever.

  5. Gray Ghost,

I could not agree with you more. The more we remove pukes like Nutsy Baloney and replace them with real Americans like LtCol Allen West and dump vermin like Dingy Reid for the likes of Marco Rubio, the better off we are.

I pray that Americans wake the hell up and purge as many liberal scumbags and RINOS as possible in 2012.

  6. TGP,

My best to your father for one. Two, I WISH that Americans could get a boycott going like we did for the Stamp Act! The TSA would disappear in a NY second.

  7. Looks like your paranoia and desperation to find something -- anything -- with which to indict the government are running wild again, Gunsel.

    >Evidently, the "right of the people
    >to be secure in their persons," was
    >somehow missed by this kangaroo court.

Nonsense. Being electronically scanned for weapons (as annoying as it indisputably is) does not make one less secure in one's person. When the same procedure is applied to everyone, it makes all air travelers rather *more* secure, and you know it.

    >These scanners are no different
    >than the TSA Gestapo having people
    >disrobe

And there we have a perfect example of the madness of Gunny.

As any sane person knows, the scanners are completely and totally different than "having people disrobe." Their very purpose, in fact, is to avoid having people disrobe, which is obviously a helluva lot more intrusive and annoying than being momentarily scanned by a machine.

Thanks, Gunster, for once again putting your fanaticism and stupidity on display.

  8. Here's what I find really interesting about all of this.

I'm a licensed pilot. As such, I can just rent a general aviation aircraft, let's say a Piper Arrow.

I can then just walk onto the airfield without any screening whatsoever, hop in my airplane, get it in the air, then crash it into anything I want.

A building; another airplane still sitting on the ground; another airplane that's in the air; whatever.

There's not a damned thing TSA could do about it.
